Prohibition of Peace Treaties when Dominant & Superior — Qur'an 47:35 النهي عن طلب السلم والهدنة في حال القوة والعلو — سورة محمد ٣٥ Prohibición de pedir la paz cuando se tiene la superioridad — Corán 47:35 শক্তি ও প্রাধান্যের সময় সন্ধি বা শান্তির আহ্বান জানানোর নিষেধাজ্ঞা — কুরআন ৪৭:৩৫
Qur'an 47:35 commands Muslims: 'So do not falter and cry out for peace while you have the upper hand and are superior, and Allah is with you.' In classical Sunni jurisprudence, this verse establishes the normative rule that peace treaties (hudna) or non-aggression pacts with non-Muslim nations are legally impermissible when the Islamic state possesses military superiority, and may only be concluded temporarily in times of extreme weakness or tactical necessity.
So do not falter and call for peace when you are superior, and Allah is with you and will never deprive you of the reward of your deeds.
His words: 'So do not falter' mean: do not show weakness in fighting your enemy; 'and call for peace' means toward reconciliation and capitulation; 'when you are superior' means when you are dominant and victorious... Thus, concluding a peace treaty (muhadana) with disbelievers is impermissible except under absolute necessity and inability to wage war against them.
Context
Editorial note — descriptive only; no modern judgment is added.
In classical Islamic international law (Siyar), this verse is cited by the major Sunni legal schools (Hanafi, Shafi'i, Maliki, Hanbali) to demarcate the strict limits of treaties with non-Muslim powers (Dar al-Harb). Jurists like al-Sarakhsi and Ibn Qudama stipulated that peace is not an enduring state between an Islamic authority and non-Muslim nations, but a tactical cessation of hostilities (Hudna) capped at a maximum of ten years, based on the precedent of the Treaty of Hudaybiyyah. If Muslims regain military capability and geopolitical superiority, initiating peace negotiations is legally prohibited, and the obligation to resume offensive expansionism (Jihad al-Talab) is reinstated.
