[EN] Conquered lands are of two categories: those taken by force ('anwah) and those taken by treaty (sulh). As for lands conquered by force through military dominance and the sword, they constitute spoils of war (ghanimah) where the ruler is given discretion: either to divide the land among the conquerors as the Prophet ﷺ did at Khaybar, or to hold it as a permanent endowment (waqf) for all Muslims and impose Kharaj land taxes upon it as Umar did with the Sawad of Iraq; and it is legally lawful to enslave all of their captured inhabitants entirely.

[EN] When the ruler conquers the Abode of War by force ('anwah), the legal ownership of the disbelievers over their property, their lands, and their own persons is completely extinguished, and all of it becomes spoils of war for the Muslims: if he wills, he executes the male fighters and enslaves the women and children; and if he wills, he settles them under Jizya and Kharaj, effectively maintaining them in a status resembling servitude through the continuous payment of agricultural tributes.

In classical Islamic international law (*al-Siyar*), the legal classification of a conquered territory determined the rights of its non-Muslim population. If a city surrendered voluntarily through negotiations before battle, a formal treaty (*Sulh*) was drafted, guaranteeing property ownership and religious practice in exchange for fixed monetary tributes. If, however, a city resisted and was conquered by armed assault (*'Anwah*), all private property and land rights were extinguished; the sovereign held the legal authority to execute captured combatants, reduce the civilian population to chattel slavery, convert temples into mosques, and annex the entire agricultural territory into state tax-producing estates.
En el derecho internacional islámico clásico (*al-Siyar*), la categoría jurídica asignada a un territorio determinaba el destino de su población. Si una ciudad capitulaba voluntariamente antes del combate, se formalizaba un tratado (*Ṣulḥ*) que garantizaba la propiedad privada y la tolerancia de templos a cambio de un tributo monetario. Si la urbe resistía y era tomada por asalto armado (*ʿAnwah*), los derechos de propiedad quedaban invalidados; el soberano adquiría la potestad de ejecutar combatientes, esclavizar a mujeres y niños, transformar santuarios en mezquitas y confiscar las tierras para imponer el impuesto territorial del Jarāŷ.
ধ্রুপদী ইসলামি আন্তর্জাতিক আইনে (আস-সিয়ার), কোনো অঞ্চল কীভাবে বিজিত হয়েছে তার ওপর ভিত্তি করে সেখানকার অমুসলিমদের নাগরিক ও ধর্মীয় অধিকার নির্ধারিত হতো। কোনো শহর যদি যুদ্ধের পূর্বেই আলোচনার মাধ্যমে আত্মসমর্পণ করত, তবে একটি সন্ধি চুক্তি (সুলহ) স্বাক্ষরিত হতো যা নির্দিষ্ট জিজিয়ার বিনিময়ে ব্যক্তিগত সম্পত্তি ও প্রাচীন উপাসনালয়ের নিরাপত্তা দিত। কিন্তু কোনো শহর যদি প্রতিরোধ গড়ে তুলত এবং যুদ্ধের মাধ্যমে তরবারির জোরে বিজিত হতো (আনওয়াহ), তবে সেখানকার নাগরিকদের সকল মালিকানা স্বত্ব আইনত বিলুপ্ত হয়ে যেত; খলিফা বা সেনাপতির জন্য যুদ্ধবন্দীদের মৃত্যুদণ্ড দেওয়া, নারী ও শিশুদের দাসত্বে নেওয়া, মন্দিরগুলোকে মসজিদে রূপান্তর করা এবং সমগ্র জমি রাষ্ট্রীয় সম্পত্তিতে পরিণত করে খেরাজ ধার্য করা বৈধ ছিল।
