[EN] The Christians of Syria wrote to Umar ibn al-Khattab: 'This is a letter from us to the servant of Allah Umar, Commander of the Faithful... We made conditions upon ourselves: that we shall not erect in our city or its surroundings any new monastery, church, cell, or monk's hermitage; nor shall we repair what has fallen into ruin... nor shall we display a cross or our scriptures in any of the roads or markets of the Muslims; nor shall we beat our clappers (wooden bells) in our churches except very softly... If we violate any of these conditions which we have accepted, then we have no covenant of protection (dhimmah), and it becomes lawful for you to do to us what is lawful against the people of rebellion and war.'
Classical commentary — Ibn Qayyim al-Jawziyya
[EN] The jurists have unanimously agreed (ittafaq al-fuqaha') that in cities founded by Muslims in the Abode of Islam—such as Basra, Kufa, Baghdad, and Cairo (Fustat)—it is strictly impermissible to construct a church, synagogue, or any non-Muslim place of worship whatsoever; and that whatever land was conquered by force ('anwah) is owned by Muslims, and the ruler has the legal right to demolish its churches.

The Pact of Umar (*al-Shurut al-'Umariyyah*) constitutes the foundational legal framework governing non-Muslim religious practice under classical Islamic rule. Transmitted by major historians and exegetes (Ibn Kathir, al-Bayhaqi, Ibn al-Qayyim, and al-Mawardi), the treaty established that while existing Christian and Jewish communities could retain their historic places of worship under specific terms, they were legally forbidden from erecting new churches, restoring damaged buildings, raising towers higher than surrounding Muslim dwellings, ringing church bells loudly, or displaying crucifixes in public. Any breach of these terms nullified their Dhimmi treaty, subjecting the population to the legal status of active belligerents.
El Pacto de Umar (*al-Shurūṭ al-ʿUmariyyah*) constituye el marco jurídico fundamental que reguló el culto no musulmán en el Islam clásico. Recogido por exegetas e historiadores de la talla de Ibn Kathir e Ibn al-Qayyim, el pacto dictaminó que, si bien se toleraba la existencia de templos históricos preexistentes en ciertas zonas, quedaba taxativamente prohibida la edificación de nuevas iglesias, la restauración de edificios en ruina, el tañido sonoro de campanas y la exhibición pública de cruces o imágenes cristianas en los mercados musulmanes.
উমরের চুক্তি (আশ-শুরুতুল উমারিয়্যাহ) হলো ধ্রুপদী ইসলামি শাসনে অমুসলিমদের ধর্মীয় অধিকার ও সামাজিক সীমাবদ্ধতা নির্ধারণের মূল আইনি সনদ। ইমাম ইবনে কাসীর ও ইবনুল কাইয়্যিমসহ শীর্ষস্থানীয় ফকীহদের দ্বারা সংরক্ষিত এই সনদে স্পষ্টভাবে শর্ত দেওয়া হয় যে, জিম্মি খ্রিস্টান ও ইহুদিরা তাদের প্রাচীন উপাসনালয় ধরে রাখতে পারলেও কোনো নতুন গির্জা, মন্দির বা মঠ নির্মাণ করতে পারবে না; ক্ষতিগ্রস্ত গির্জা সংস্কার করতে পারবে না; মুসলিমদের চেয়ে উঁচু ভবন নির্মাণ করতে পারবে না; গির্জার ঘণ্টা জোরে বাজাতে পারবে না এবং বাজারে প্রকাশ্য ক্রুশ প্রদর্শন করতে পারবে না। এসব শর্ত ভঙ্গ করলে তাদের নিরাপত্তা চুক্তি বাতিল হয়ে যাবে এবং তাদের বিরুদ্ধে যুদ্ধ ঘোষণা বৈধ হবে।
