Indeed, We sent down the Torah, in which was guidance and light, by which the prophets who submitted judged for the Jews, and the rabbis and scholars, by what they were entrusted of the Book of Allah, and they were witnesses to it. So fear not the people, but fear Me, and do not sell My verses for a small price. And whoever does not judge by what Allah has revealed — those are the disbelievers.
Ciertamente, hicimos descender la Torá, en la que había guía y luz; con ella juzgaban los profetas que se sometieron para los judíos, y los rabinos y los eruditos, según lo que se les había confiado del Libro de Allah, y eran testigos de ello. [EN] Ali ibn Abi Talha narrated from Ibn Abbas on His statement 'whoever does not judge by what Allah revealed — those are the disbelievers': 'Whoever denies what Allah revealed has disbelieved; whoever affirms it while acting otherwise is an unjust, rebellious person.' Al-Thawri narrated from Ibn Jurayj from Ata: 'It is kufr below kufr, injustice below injustice, and transgression below transgression.' Waki' narrated from Sa'id al-Makki from Tawus on the verse: 'It is not a kufr that removes one from the religion [al-milla].' Ibn Jarir [al-Tabari] then chose the view that the verse refers to the People of the Book, or to whoever denies the ruling of Allah revealed in the Book.

Qur'an 5:44-47 contains three companion verses — 'those are the disbelievers' (44), 'those are the unjust' (45), 'those are the rebellious' (47). The classical exegetes record that the verses were revealed in the context of the Jews of Medina (the stoning case of the married adulterers, which the Prophet was asked to judge; the earlier part of the sura describes the Jews' concealment of the Torah's ruling) — Ibn Jarir chose that the verses refer to the People of the Book or to whoever denies an explicit revealed ruling. The classical spectrum of interpretation is recorded by Ibn Kathir above: Ibn Abbas (denial = disbelief; affirmation with contrary action = injustice/rebellion), Ata and Tawus ('kufr below kufr' — not removing one from the religion), and al-Sha'bi (applying the three verses respectively to Muslims, Jews, and Christians). The classical political doctrine built on these and related texts: the classical treatises on governance (al-Mawardi, al-Ahkam al-Sultaniyya; Ibn Taymiyya, al-Siyasa al-Shar'iyya) proceed from the premise that the imamate succeeds prophecy in 'guarding the religion and governing the world', and that the law applied in the public order is the sharia — legislation by other than divine law was not a category classical law recognized. It should be noted that the term 'hakimiyya' itself is a modern coinage (used by later 20th-century writers); the classical texts speak of hukm li-llah, 'the judgment belongs to Allah' (cf. Qur'an 12:40, 6:57).
