Narrator: Ikrima, on the authority of Ibn Abbas
Ikrima reported: Some zanadiqa (heretics/atheists) were brought to Ali, and he burned them. This reached Ibn Abbas, who said: 'Had I been in his place, I would not have burned them, because of the prohibition of the Messenger of Allah ﷺ [against punishing with fire]; but I would have killed them, because of the statement of the Messenger of Allah ﷺ: "Whoever changes his religion, kill him."'
Ikrima narró: Fueron llevados ante Ali unos zanadiqa (herejes/ateos) y él los quemó. Abd Allah (ibn Mas'ud) reported: The Messenger of Allah ﷺ said: 'It is not permissible to take the life of a Muslim who testifies that there is no god but Allah and that I am the Messenger of Allah, except in one of three cases: the married fornicator, a life for a life, and the one who abandons his religion, separating from the community.'
Abd Allah (ibn Mas'ud) narró: El Mensajero de Allah ﷺ dijo: «No es lícito derramar la sangre de un musulmán que testifica que no hay más dios que Allah y que yo soy el Mensajero de Allah, salvo en uno de tres casos: el fornicario casado, una vida por una vida, y quien abandona su religión separándose de la comunidad».

[EN] The people of knowledge are agreed (ijma) that the apostate from the laws of Islam — if male — is to be executed. They differed over the female apostate: Abu Hanifa held that she is not executed but is imprisoned and compelled to Islam, while the majority of the jurists — and this is the position of al-Shafi'i, Malik, and Ahmad — held that she is executed. The hadith 'whoever changes his religion, kill him' is recorded in Sahih al-Bukhari (nos. 3017 and 6922) and is the principal text for the classical ruling on apostasy. Ibn Qudama (al-Mughni, Kitab al-Ridda) records the consensus of the jurists that the adult male apostate is executed, with the divergence over the female (execution per the majority; imprisonment per Abu Hanifa). The classical jurists discussed the call to repentance (istitaba) before the sentence, and the schools differ on whether it is obligatory or recommended. The classical ruling is understood within the jurisdiction of the Islamic state — it presumes the authority of the Muslim polity, and the classical texts also record that the apostate who returns to Islam before execution is spared. Historically, the Companions applied the ruling in the Ridda wars of the 11th year of the Hijra, when, under Abu Bakr, the community agreed to fight those who had apostatized and withheld zakat (Sahih al-Bukhari, Kitab Istitabat al-Murtaddin). The Quranic verses on apostasy (2:217; 3:90; 47:25-28) speak of the nullification of deeds and the afterlife punishment; the death penalty is derived by the classical jurists from the hadith.
