The classical Islamic legal ruling across the majority of schools (Maliki, Hanafi, Hanbali) that a Zindiq (a covert atheist, dualist, or esoteric heretic who outwardly pretends to be Muslim) is sentenced to immediate death upon discovery, with repentance rejected. مذهب جمهور الفقهاء في أن الزنديق الذي يُظهر الإسلام ويُبطن الكفر والردة يُقتل حداً وقضاءً ولا تُقبل توبته الظاهرة بعد القدرة عليه. Classical commentary — Ibn Qudama
[EN] The Zindiq is the one who conceals disbelief (kufr) and outwardly displays Islam. His outward repentance is not accepted, and he is to be put to death when apprehended. This is the school of Malik, Abu Hanifah, and Ahmad in one of his narrations; because the truthfulness of his repentance cannot be known since hypocrisy is his established habitual practice.
Classical commentary — Al-Sarakhsi
[EN] When the ruler captures a Zindiq, repentance is not sought from him; rather, he is executed immediately, because he merely professes [Islam] which he was already pretending before his arrest. Thus his repentance cannot be verified by verbal affirmation, and his execution is a mandatory prescribed punishment (hadd) that is not waived by repentance, like the punishment for adultery.

In classical Islamic public law, a distinction is drawn between an ordinary apostate (Murtadd zahir, whose public renunciation allows a standard 3-day grace period for repentance / Istitabah) and a Zindiq (crypto-heretic or dualist). Classical jurisprudence under the Abbasid and Umayyad Caliphates established dedicated offices of state inquisition (Sahib al-Zanadiqa) to identify and prosecute secret dualists, Manichaeans, and philosophical deniers of the resurrection. The Maliki, Hanafi, and Hanbali schools ruled that allowing a Zindiq to escape execution by repeating the Shahada would undermine public legal authority.
En el derecho público islámico clásico se distingue entre el apóstata común (Murtadd zāhir, a quien se otorga un plazo preceptivo de tres días para retractarse) y el Zindīq (cripto-hereje o heterodoxo encubierto). Durante los califatos omeya y abasí se crearon magistraturas especiales de inquisición estatal (Ṣāḥib al-Zanādiqah) para juzgar a maniqueos y librepensadores.
