O you who have believed, prescribed for you is legal retribution (al-qisas) for those murdered: the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother [i.e., the killer] anything, then there should be a suitable follow-up and payment to him with good conduct.
¡Oh creyentes! Se os ha prescrito el talión (al-qiṣāṣ) en caso de homicidio: el libre por el libre, el esclavo por el esclavo y la mujer por la mujer. Mas a quien le sea perdonado algo por su hermano, que se cumpla de forma honorable y se indemnice con generosidad.

Narrated Ali and Ibn Abbas: The Prophet ﷺ said: 'A free person shall not be killed for a slave, nor a Muslim for a disbeliever.'

Classical commentary — Ibn Qudama
[EN] A free person is not killed for a slave according to the majority of scholars, including al-Nakha'i, Malik, al-Thawri, al-Shafi'i, Ishaq, and Abu Thawr... because the slave is owned property, so a free person is not put to death for him just as he is not put to death for an animal.

Qur'an 2:178 specifies that in cases of homicide, retribution must maintain structural equivalence ('the free for the free, the slave for the slave'). The overwhelming majority of classical Sunni jurists (Jumhur: Malik, al-Shafi'i, Ahmad ibn Hanbal) ruled that capital punishment (Qisas) requires equality in social status (Kafa'ah); hence, a free person who murders someone else's slave only pays financial compensation (the market value / Qimah of the slave to the owner), but cannot be executed. Abu Hanifah held the lone dissenting position among the four schools, arguing that a free person may be executed for killing another person's slave (though not for his own slave).
El Corán 2:178 estipula que en el homicidio se debe preservar la equivalencia de estatus («el libre por el libre, el esclavo por el esclavo»). La gran mayoría de juristas clásicos (Mālik, al-Shāfiʿī y Aḥmad ibn Ḥanbal) determinaron que la pena capital por talión (Qiṣāṣ) requiere paridad social; por ende, el hombre libre que asesina a un siervo ajeno solo está obligado a indemnizar al dueño con el valor mercantil del esclavo (Qīmah), sin incurrir en ejecución. Abu Hanifa sostuvo una postura minoritaria que permitía la ejecución por matar al esclavo ajeno, aunque no por el propio.
কুরআন ২:১৭৮ আয়াতে হত্যার সমকক্ষ প্রতিশোধের ক্ষেত্রে সামাজিক মর্যাদার সমতা বজায় রাখার কথা বলা হয়েছে ('স্বাধীনের বদলে স্বাধীন, দাসের বদলে দাস')। সংখ্যাগুরু ধ্রুপদী ফকীহগণ (মালিক, শাফিয়ি, আহমাদ ইবনে হাম্বল) সিদ্ধান্ত দেন যে কেসাসের মূল শর্ত হলো সমমর্যাদা (কাফায়াত); অতএব কোনো স্বাধীন ব্যক্তি অপরের দাসকে হত্যা করলে তাকে মৃত্যুদণ্ড দেওয়া যাবে না, বরং সে কেবল দাসের মালিককে বাজারমূল্য (কিমাহ) ক্ষতিপূরণ দিতে বাধ্য থাকবে। ইমাম আবু হানিফা এক্ষেত্রে একক ভিন্নমত পোষণ করে পরকীয় দাস হত্যার ক্ষেত্রে স্বাধীন ব্যক্তির মৃত্যুদণ্ড বৈধ বললেও নিজের ক্রীতদাসকে হত্যার ক্ষেত্রে মৃত্যুদণ্ড বাতিল ঘোষণা করেন।
