And [forbidden to you in marriage are] married women, except what your right hands possess — [this is] the decree of Allah upon you. And lawful to you are all beyond these, that you seek [them] by your wealth, being chaste, not fornicating. So for whatever you enjoy from them, give them their compensation as an obligation; and there is no blame upon you for what you mutually agree upon after the obligation. Verily, Allah is Knowing, Wise.
And those who guard their private parts — except with their wives or what their right hands possess, for then they are not to be blamed. (5-6)
Sahih al-Bukhari, Kitab al-Buyu', no. 2235 (in-book: Book 34, hadith 181)
Narrator: Anas ibn Malik
Anas ibn Malik reported: The Prophet ﷺ came to Khaybar; when Allah granted him victory over the fortress, the beauty of Safiyya bint Huyayy ibn Akhtab was mentioned to him — her husband had been killed and she was a bride. The Messenger of Allah ﷺ chose her for himself and set out with her; when we reached Sadd al-Rawha', she became lawful [her waiting period ended], and he consummated the marriage with her. Then he made hais [a sweet dish] on a small leather sheet and said: 'Inform those around you.' That was the wedding banquet of the Messenger of Allah ﷺ for Safiyya.
Tafsir al-Qur'an al-'Azim, on 4:24
Classical commentary — Ibn Kathir
[EN] His statement 'except what your right hands possess' — i.e., from the captives of war: her master may lawfully have sexual relations with her by right of possession (milk al-yamin) without a marriage contract. This is established by consensus and the sunna. Safiyya, may Allah be pleased with her, was among the captives of Khaybar; the Prophet ﷺ freed her and married her, making her manumission her dower. [Summary of the classical position as recorded by Ibn Kathir; see his Tafsir on 4:24.]
Context
Editorial note — descriptive only; no modern judgment is added.
The Qur'an permits sexual relations with female captives taken in war ('what your right hands possess', 4:24; 23:6; 33:50; 70:30), a permission the classical jurists (Ibn Kathir as above; al-Qurtubi on 23:6; Ibn Qudama, al-Mughni) held by consensus, subject to the rules of the institution: the woman becomes the man's property by capture; the jurists required istibra' (waiting one menstrual period) for a captive whose husband was alive, and the children of a master by his slave-girl are free, and she becomes an umm walad who cannot be sold. The classical law of war per the Qur'an and sunna allowed enslavement of captives or their release by ransom or favor (47:4; 8:67). Alongside the permission, the Qur'an contains a strong manumission ethic: freeing slaves as expiation for sins (4:92; 5:89; 58:3; 90:13), zakat for the freeing of captives (9:60), and the encouragement of manumission contracts (24:33). The Khaybar episode (above) records the operative precedent: Safiyya, whose husband was killed in the conquest, was taken captive and fell to the share of the Prophet, who freed her and married her — the classical sources present both the institution and its path of manumission.
