فَإِذَا لَقِيتُمُ ٱلَّذِينَ كَفَرُوا۟ فَضَرْبَ ٱلرِّقَابِ حَتَّىٰٓ إِذَآ أَثْخَنتُمُوهُمْ فَشُدُّوا۟ ٱلْوَثَاقَ فَإِمَّا مَنًّۢا بَعْدُ وَإِمَّا فِدَآءً حَتَّىٰ تَضَعَ ٱلْحَرْبُ أَوْزَارَهَا ۚ ذَٰلِكَ وَلَوْ يَشَآءُ ٱللَّهُ لَٱنتَصَرَ مِنْهُمْ وَلَـٰكِن لِّيَبْلُوَا۟ بَعْضَكُم بِبَعْضٍ ۗ وَٱلَّذِينَ قُتِلُوا۟ فِى سَبِيلِ ٱللَّهِ فَلَن يُضِلَّ أَعْمَـٰلَهُمْ

So when you meet those who disbelieve, strike [their] necks until, when you have inflicted heavy casualties upon them, then bind firmly the bonds; thereafter either favor [release without ransom] or ransom, until the war lays down its burdens. That is [the command]; and if Allah had willed, He could have taken vengeance upon them, but [He ordered it] that He may test some of you by others. And those who are killed in the way of Allah — He will never let their deeds be lost.

Y cuando os encontréis con los que niegan la verdad, golpeadles los cuellos; y cuando les hayáis infligido grandes bajas, apretad las ataduras. Luego, o bien favor [liberación sin rescate] o bien rescate, hasta que la guerra deponga sus cargas. Eso es [el mandato]; y si Allah hubiera querido, se habría vengado de ellos, pero [lo ordena] para probaros unos a otros. Y a quienes mueran en el camino de Allah, Él no dejará jamás que sus obras se pierdan.

অতএব যখন তোমরা কাফিরদের মুখোমুখি হও, তবে গর্দানে আঘাত করো; অতঃপর যখন তাদের (যুদ্ধে) দুর্বল করে দাও, তখন শক্ত করে বাঁধো। এরপর হয় অনুগ্রহ (বিনা মুক্তিপণে মুক্তি) নয়তো মুক্তিপণ — যতক্ষণ না যুদ্ধ তার ভার নামিয়ে রাখে। এই তো (বিধান); আল্লাহ চাইলে তাদের থেকে প্রতিশোধ নিতে পারতেন, কিন্তু তিনি চান তোমাদের একে অপরের মাধ্যমে পরীক্ষা করতে। আর যারা আল্লাহর পথে নিহত হয়, তিনি তাদের আমল কখনো বিনষ্ট করবেন না।

Classical commentary — Ibn Kathir

وَقَوْلُهُ: «فَإِمَّا مَنًّا بَعْدُ وَإِمَّا فِدَاءً» أَيْ بَعْدَ الْأَسْرِ وَالتَّثْبِيتِ إِمَّا أَنْ يَمُنُّوا عَلَيْهِمْ بِإِطْلَاقِهِمْ مِنْ غَيْرِ فِدَاءٍ، وَإِمَّا أَنْ يُفَادُوا بِالْأَمْوَالِ، وَقَدِ اخْتَلَفَ الْفُقَهَاءُ فِي حُكْمِ الْأَسِيرِ، فَقِيلَ: يُخَيَّرُ الْإِمَامُ بَيْنَ الْقَتْلِ وَالِاسْتِرْقَاقِ وَالْمَنِّ وَالْفِدَاءِ.

[EN] His statement 'then either favor or ransom' — i.e., after capture and binding, either they are shown favor by release without ransom, or they are ransomed for wealth. The jurists differed over the captive's fate: it is said the imam is given the choice between execution, enslavement, release by favor, and ransom. فاذا لقيتم ٱلذين كفروا فضرب ٱلرقاب حتى اذا اثخنتموهم فشدوا ٱلوثاق فاما منا بعد واما فداء حتى تضع ٱلحرب اوزارها ذلك ولو يشاء ٱلله لٱنتصر منهم ولكن ليبلوا بعضكم ببعض وٱلذين قتلوا فى سبيل ٱلله فلن يضل اعملهم وقوله: «فاما منا بعد واما فداء» اي بعد الاسر والتثبيت اما ان يمنوا عليهم باطلاقهم من غير فداء، واما ان يفادوا بالاموال، وقد اختلف الفقهاء في حكم الاسير، فقيل: يخير الامام بين القتل والاسترقاق والمن والفداء.

Qur'an 47:4 sets the scriptural frame of the classical law of captives: the battle order (striking the necks) applies until the enemy is subdued; thereafter captives are bound, and the imam chooses between release by favor (mann) and ransom (fida'). The classical jurists (Ibn Kathir as above; al-Mawardi; Ibn Qudama) derived from this verse, from 8:67, and from the practice of the Prophet the imam's authority over captives — the schools differ over the full range of options (execution, enslavement, favor, or ransom), with some restricting the choice to the two named in the verse after the war has ended. The verse explicitly ends the state of warfare ('until the war lays down its burdens') and presents the whole as a divine test rather than an act of vengeance. The enslavement of captives, practiced in the classical period (see the entry 'what your right hands possess' and Khaybar), was the third option discussed by the jurists alongside the two named in the text.

El Corán 47:4 fija el marco escritural del derecho clásico de los cautivos: la orden de batalla (golpear los cuellos) rige hasta someter al enemigo; luego se ata a los cautivos, y el imam elige entre liberarlos por favor (mann) o por rescate (fida'). Los juristas clásicos (Ibn Kathir, arriba; al-Mawardi; Ibn Qudama) derivaron de esta aleya, de 8:67 y de la práctica del Profeta la autoridad del imam sobre los cautivos — las escuelas difieren sobre el abanico completo de opciones (ejecución, esclavitud, favor o rescate), y algunas restringen la elección a las dos mencionadas en la aleya una vez terminada la guerra.
