The four penalties for those who wage war against Allah and His Messenger and spread corruption in the land — execution, crucifixion, amputation of the hand and foot from opposite sides, or exile — with the repentance exception. العقوبات الأربع لمن يحارب الله ورسوله ويسعى في الأرض فسادًا — القتل أو الصلب أو قطع الأيدي والأرجل من خلاف أو النفي — مع استثناء التوبة قبل القدرة. Indeed, the recompense of those who wage war against Allah and His Messenger and strive in the land spreading corruption is only that they be killed, or crucified, or have their hands and feet cut off from opposite sides, or be exiled from the land. That is for them a disgrace in this world, and for them in the Hereafter a great punishment. (33) Except for those who repent before you overpower them — know that Allah is Forgiving, Merciful. (34)
Ciertamente, la retribución de quienes hacen la guerra contra Allah y Su Mensajero y se esfuerzan en la tierra sembrando la corrupción es solo que sean muertos, o crucificados, o que se les corten las manos y los pies de lados opuestos, o que sean desterrados de la tierra. Eso es para ellos una desgracia en este mundo, y para ellos en la otra vida un gran castigo. (33) Salvo quienes se arrepientan antes de que podáis con ellos — sabed que Allah es Indulgente, Misericordioso. (34)

[EN] The jurists differed over the muharib [brigand]: al-Shafi'i held that the imam is given the choice among execution, crucifixion, cross-amputation of the hand and foot, and exile, according to what he deems the public interest; Abu Hanifa held that if he killed he is executed, if he robbed the road without killing his hand and foot are cut from opposite sides, and if he took no property and killed no one he is exiled. The classical exegetes connect 5:33 to the incident of the Urayna tribesmen, who feigned conversion, then killed the shepherd of the Prophet's camels and drove the camels away, and were punished (the incident is recorded in the hadith collections; see also the classical discussions of its details). The verse's four penalties are graded in classical fiqh by the nature of the crime: execution for killing, crucifixion for killing with the taking of property, cross-amputation for taking property without killing, and exile for terrorizing without killing or theft — a grading recorded by al-Mawardi (above), with the schools differing on whether the imam chooses freely or the penalties are fixed to the crime. Verse 5:34 exempts those who repent before being overpowered — the classical jurists differ on whether repentance after capture spares the hadd or only the punishment of the afterlife. The penalty of mutilation involved in cross-amputation is specific to this offence; the Prophet later prohibited mutilation generally (recorded in the hadith literature).
