حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، عَنِ ابْنِ جُرَيْجٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ: «كُنَّا نَبِيعُ أُمَّهَاتِ الْأَوْلَادِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ وَأَبِي بَكْرٍ، فَلَمَّا كَانَ عُمَرُ نَهَانَا فَانْتَهَيْنَا».

Narrated Jabir ibn Abd Allah: 'We used to sell our female slave-mothers of children (ummahāt al-awlād) during the lifetime of the Messenger of Allah ﷺ and during the Caliphate of Abu Bakr. But when Umar became Caliph, he forbade us from doing so, and so we stopped.'

জাবির ইবনে আবদুল্লাহ (রা.) থেকে বর্ণিত: 'আমরা রাসূলুল্লাহ ﷺ-এর যুগে এবং আবু বকর (রা.)-এর খেলাফতকালে আমাদের সন্তানবতী দাসীদের (উম্মে ওয়ালাদ) বিক্রি করতাম। অতঃপর উমর (রা.)-এর খেলাফতের সময় তিনি আমাদের তা করতে নিষেধ করলেন, ফলে আমরা তা থেকে বিরত হলাম।'

Classical commentary — Ibn Qudama

ذَهَبَ جُمْهُورُ الصَّحَابَةِ وَالْفُقَهَاءِ إِلَى أَنَّ أُمَّ الْوَلَدِ لَا يَجُوزُ بَيْعُهَا وَلَا هِبَتُهَا، وَتُعْتَقُ مِنْ رَأْسِ الْمَالِ بِمَوْتِ سَيِّدِهَا... وَكَانَ عَلِيٌّ وَابْنُ عَبَّاسٍ وَجَابِرٌ يَرَوْنَ جَوَازَ بَيْعِهَا فِي حَالِ حَيَاةِ سَيِّدِهَا ثُمَّ رَجَعَ عَلِيٌّ إِلَى قَوْلِ عُمَرَ.

[EN] The majority of Companions and jurists held that an Umm al-Walad may not be sold or given as a gift, and she becomes emancipated from the primary estate upon the death of her master... While Ali, Ibn Abbas, and Jabir initially held the view permitting her sale during the master's lifetime, Ali later returned to Umar's ruling.

حدثنا مسدد، حدثنا يحيى، عن ابن جريج، عن ابي الزبير، عن جابر بن عبد الله، قال: «كنا نبيع امهات الاولاد على عهد رسول الله ﷺ وابي بكر، فلما كان عمر نهانا فانتهينا». ذهب جمهور الصحابة والفقهاء الى ان ام الولد لا يجوز بيعها ولا هبتها، وتعتق من راس المال بموت سيدها... وكان علي وابن عباس وجابر يرون جواز بيعها في حال حياة سيدها ثم رجع علي الى قول عمر.

An Umm al-Walad ('mother of a child') is a female slave concubine who gives birth to a child fathered by her master. This authentic report in Sunan Abi Dawud and Sunan al-Nasa'i documents that during the Prophet's lifetime and under the first Caliph Abu Bakr, slave concubines who had borne children to their owners were treated as fully alienable commercial property who could be bought, sold, and traded in slave markets. During the Second Caliphate, Umar ibn al-Khattab issued an administrative prohibition against selling them, ruling that an Umm al-Walad must be emancipated automatically upon her master's death without impacting inheritance shares.

La Umm al-Walad ('madre de hijo') era la concubina esclava que concebía un hijo de su amo. Este relato canónico en Sunan Abī Dāwūd constata que durante la vida del Profeta y el califato de Abu Bakr, las concubinas con descendencia eran vendidas y traspasadas libremente en los mercados de esclavos. উম্মে ওয়ালাদ হলো সেই দাসী যে তার মনিবের ঔরসজাত সন্তান প্রসব করে। সুনান আবু দাউদ ও নাসাঈর এই বিশুদ্ধ বর্ণনাটি প্রমাণ করে যে স্বয়ং রাসুলুল্লাহ ﷺ-এর জীবদ্দশায় এবং প্রথম খলিফা আবু বকর (রা.)-এর শাসনকালে সন্তান জন্মদানকারী দাসীদেরও বাজারে সাধারণ পণ্যের মতো কেনাবেচা করা হতো। পরবর্তীতে দ্বিতীয় খলিফা উমর (রা.) রাষ্ট্রীয়ভাবে উম্মে ওয়ালাদ বিক্রি নিষিদ্ধ ঘোষণা করেন এবং আইন প্রণয়ন করেন যে মনিবের মৃত্যুর পর সে উত্তরাধিকার সম্পত্তির বাইরে গিয়ে সরাসরি মুক্ত হয়ে যাবে।
